<p>You’ve booked the venue, found <em>the</em> dress, and are deep in flower-arch Pinterest boards — but have you talked about a prenup yet?</p>



<p>No longer the domain of the ultra-rich or overly cautious, prenuptial agreements are becoming the quietly confident power move for couples who want to protect their futures <em>and</em> their feelings. We spoke to legal director at <a href="https://www.buckles-law.co.uk/">Buckles Law</a>, <a href="https://www.buckles-law.co.uk/staff/rebecca-varey/">Rebecca Varey</a>, to find out what you need to know.</p>



<h3 class="wp-block-heading" id="h-so-why-would-anyone-need-a-prenup">So… Why would anyone need a prenup?</h3>



<p>Think of it as a grown-up, no-drama plan for a “just in case” scenario. For Rebecca, a prenup helps streamline and simplify what can be a messy, expensive process <a href="https://suffolkcambs.muddystilettos.co.uk/life/legal-advice-to-consider-before-you-get-married/">if things don’t go to plan</a>. She says it can:</p>



<ul>
<li>Protect assets you already own (like property or inheritance)</li>



<li>Shield you from your partner’s debts</li>



<li>Ringfence a family business</li>



<li>Ensure children from a previous relationship are looked after<br>In short? Clarity, certainty, and keeping potential future legal fees down. Smart.</li>
</ul>



<h3 class="wp-block-heading" id="h-are-prenups-actually-worth-the-paper-they-re-written-on">Are prenups actually worth the paper they&#8217;re written on?</h3>



<p>Yes — more than ever. While they’re not <em>yet</em> 100% legally binding, courts are giving serious weight to prenups, provided they’re fair and well-constructed. In fact, according to Rebecca, proposals from the Law Commission recommend formalising these into what’s known as a <strong>Qualifying Nuptial Agreement</strong> — one that could stop courts from overriding the terms during a divorce. <h3 class="wp-block-heading" id="h-what-makes-a-prenup-qualifying">What makes a prenup &#8220;qualifying&#8221;?</h3>



<p>According to Rebecca, to carry real legal clout, a prenup must:</p>



<ul>
<li>Be signed freely and with full understanding by both parties</li>



<li>Be properly executed as a legal deed</li>



<li>Include full financial disclosure on both sides</li>



<li>Be based on independent legal advice for both parties</li>



<li>Not disadvantage any children or leave either party in financial hardship</li>
</ul>



<h3 class="wp-block-heading" id="h-how-do-you-go-about-it">How do you go about it?</h3>



<p>For Rebecca, the first step is to start with a good lawyer (preferably one with prenup experience). They’ll walk you through your rights, obligations and the best way to draft the agreement based on your personal circumstances.</p>



<h3 class="wp-block-heading" id="h-what-should-you-talk-about">What should you talk about?</h3>

<p>This is where the real grown-up conversation happens. What’s yours, mine and ours? What should be included in the marital pot, and what do you each want to protect? For Rebecca, transparency now means fewer surprises later.</p>



<h3 class="wp-block-heading" id="h-what-needs-to-be-included">What needs to be included?</h3>



<p>Rebecca says to expect to lay all your cards on the table — property, pensions, savings, debts, income streams, even that investment flat in Shoreditch. Full financial disclosure is essential to make your prenup stand up in court.</p>



<h3 class="wp-block-heading" id="h-how-do-you-make-it-fair">How do you make it fair?</h3>



<p>A good prenup doesn’t just protect — it supports. Rebecca advises that it should account for both partners’ future needs: think housing, pensions, income, and what happens if children come along. She tells us that many include a review clause, so the agreement can evolve as your life together does.</p>



<h3 class="wp-block-heading" id="h-but-isn-t-this-all-a-bit-unromantic">But isn’t this all a bit… unromantic?</h3>

<p>Only if you let it be. Rebecca likes to think of a prenup like insurance — you hope you’ll never need it, but it brings peace of mind. She recommends discussing it openly, early (ideally several months before the wedding), and with mutual respect can actually strengthen your relationship. Then, with the admin out of the way, you’re free to focus on what matters: champagne tastings, guest lists, and that honeymoon in the Maldives.</p>
